TERMS & CONDITIONS

Please read these terms and conditions carefully before using the DNS Advisor Online Tool or any related reports or information (collectively, the "Tool").  This is a legal agreement between you and Infoblox Inc. (“Infoblox”).  BY CONTINUING OR USING THE TOOL, YOU AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS.  “You” refers to the person using the Tool.  If the Tool is being used on behalf of an entity by a representative authorized to use the Tool on behalf of such entity, then “you” also refers to such entity. You must be at least 18 years of age to use the Tool. 

These DNS Advisor Terms of Use (“Terms”) apply to all use of the Tool. Infoblox and its affiliates and suppliers make the Tool available to you only under these Terms. You are encouraged to print a copy of these Terms for your records. 

Infoblox may change these Terms without notice to you.  If Infoblox changes these Terms, Infoblox will post the updated Terms on this page. By continuing to use the Tool after posting of updated Terms, you accept any changes to these Terms.

Your Obligations for Use of the Tool 
You agree that you will only use the Tool to test the configuration of a domain that is owned or controlled by you, or that you are otherwise authorized to configure and manage.  You agree that you will provide Infoblox with an accurate and valid e-mail address at which you can be contacted.

In using or accessing the Tool, you agree: (i) not to use a false identity; (ii) not to access or attempt to access any data, content or systems which you are not authorized to access; (iii) not to damage, disrupt or interfere with the integrity or security of the Tool, or with any related web site or network; and (iv) not to use any data mining, robots, crawling or other automated data gathering and extraction methods in connection with the Tool.

Your use of Tool is subject to all applicable laws and regulations. You agree that in using the Tool, you will strictly comply with all laws and regulations.

At your sole cost and expense, you shall defend, indemnify and hold Infoblox, as well as its parents, subsidiaries, affiliates, officers, shareholders, employees and independent contractors, harmless from and against any and all damages, liabilities, costs and expenses including reasonable attorneys' fees arising from any third party claims, due to or arising out of your use of the Tool or your violation of these Terms.  In addition to any other rights Infoblox may have, Infoblox may immediately terminate your access to the Tool, without notice, if Infoblox believes you have violated these Terms or otherwise engaged in activity that could be harmful to Infoblox, any other Infoblox customer, or any third party.

Comments are Welcome
Infoblox welcomes your comments about the Tool. However, if you send Infoblox an idea or suggestion -- for example, about how to improve the Tool -- you agree that Infoblox will be completely free to implement, use or modify, in any way, your idea or suggestion (or any part of it), without any payment or other obligation to you.

Intellectual Property
Infoblox makes the Tool available to you online on a nonexclusive basis for your internal use only to test systems that you manage or control; Infoblox and its suppliers do not grant any other rights, express or implied, to the Tool or related content. The Tool and related content (including the “look and feel,” selection and arrangement thereof) are the property of Infoblox or its suppliers and are protected by copyright, trademark and other intellectual property laws.  You agree not to copy, republish, frame, download, transmit, modify, sublicense, reverse engineer, or create derivative works based on the Tool or related content.
DNS Advisor, Infoblox, the Infoblox logo are trademarks of Infoblox. All marks used on or in connection with Tool, and all goodwill in and to such names and marks are the property of Infoblox or its suppliers. You are not permitted to use the marks without the prior written consent of Infoblox.

Limitation of Liability
Since Infoblox makes the Tool available without charge, Infoblox does not assume any liability relating to your use of the Tool. Although Infoblox endeavors to provide a quality service, you expressly agree that such use is at your own risk.  Infoblox is not responsible for claims brought by third parties arising from your use of Tool. The Tool could include technical or other errors.  Under no circumstances will Infoblox (or any of its affiliates, officers, directors, employees, or agents) be liable for any loss or damage caused by your reliance on information or analysis obtained through the Tool, whether or not such information is inaccurate and whether or not the inaccuracy is due to fault or error by Infoblox.  It is your responsibility to evaluate the information, analysis and other content available through the Tool.
IN NO EVENT WILL INFOBLOX BE LIABLE TO YOU OR ANY OTHER PERSON OR ENTITY, UNDER ANY THEORY, INCLUDING NEGLIGENCE, FOR DAMAGES OF ANY KIND ARISING FROM THE USE OF THE TOOL, INCLUDING BUT NOT LIMITED TO ANY INDIRECT, ACTUAL, INCIDENTAL, PUNITIVE, SPECIAL OR CONSEQUENTIAL DAMAGES, LOST INCOME, REVENUE OR PROFITS, LOST OR DAMAGED DATA, SYSTEM DOWNTIME, OR OTHER COMMERCIAL OR ECONOMIC LOSS THAT RESULT FROM YOUR USE OF, OR INABILITY TO USE, THE TOOL, EVEN IF INFOBLOX HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OR SUCH DAMAGES ARE FORESEEABLE. THIS LIMITATION WILL APPLY TO ALL INFORMATION, ANALYSES, CONTENT, AND DATA AVAILABLE THROUGH THE TOOL.  YOU FURTHER AGREE THAT IN NO EVENT WILL INFOBLOX’S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES AND CAUSES OF ACTION OF ANY KIND RELATING TO THE TOOL EXCEED FIFTY US DOLLARS IN THE AGGREGATE.

INFOBLOX PROVIDES THE TOOL "AS IS." INFOBLOX DISCLAIMS ALL REPRESENTATIONS, WARRANTIES AND GUARANTEES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE.  INFOBLOX DOES NOT WARRANT THAT THE RESULTS OBTAINED FROM THE USE OF THE TOOL OR MATERIALS WILL BE EFFECTIVE, COMPLETE, ACCURATE, OR RELIABLE.

Information and Privacy
Infoblox does not store reports generated by the Tool.  Infoblox may store your email address, IP address and similar information; to learn about how Infoblox protects your email address and other personal information, please refer to the Infoblox Privacy Policy.  Infoblox may disclose your email and other information relating to your use of the Tool to law enforcement authorities and/or affected third parties if requested by law enforcement or other government entities, or if Infoblox believes that your use of the Tool may be illegal or harmful to third parties. 

Miscellaneous
These Terms of Use and other rules, guidelines, licenses, and disclaimers posted in connection with the Tool constitute the entire agreement between Infoblox and you with respect to your use of the Tool.  The formation, construction and interpretation of these Terms will be controlled by the laws of the State of California as if made between California residents entered into and to be performed within California, and giving no effect to its choice of law provisions. The U.N. Convention of Contracts for the International Sale of Goods is expressly excluded from any interpretation of these Terms.  The Uniform Computer Transaction Act as adopted in some States in the United States of America will not apply. Any dispute relating to these Terms will be subject to the exclusive jurisdiction of the state and federal courts in Santa Clara County, California, U.S.A., and the parties agree to submit to the personal and exclusive jurisdiction and venue of these courts. The Tool is created, controlled and operated by Infoblox in the State of California, USA.  If any provision of this License is held to be unlawful, void or for any reason unenforceable, that provision will be deemed severable from this agreement and will not affect the validity and enforceability of the remaining provisions.
